The claim of Donovan, appellee, is that he was security for FT. A. Beisecker and John A. Johnson, firm of Beisecker & Johnson, on a promissory note executed to Samuel A. Barry; and that Barry brought suit thereon, and there being no service on Beisecker, recovered judgment against said Johnson and appellee, from which Johnson appealed to the Supreme Court, where the judgment was affirmed, and afterward paid by appellee, an execution having been levied upon liis property.
