Marshall Fincher was evicted from public housing and brought this lawsuit in state court against the South Bend Housing Authority under a variety of theories. The Housing Authority removed the case to federal court and it now presents reasons why it is entitled to summary judgment on each claim. But as the Housing Authority also points out, there is a preliminary jurisdictional question.
