OPINION OF THE COURT

LEWIS, Circuit Judge.

Appellant Shammara Richards is the wife and personal representative of the estate of Charles A. Richards, Jr. She appeals from the District Court’s order dismissing her complaint for lack of subject-matter jurisdiction under Fed.R.Civ.P. 12(b)(1). In particular, Mrs. Richards asks that we allow her negligence claims against the United States under the Federal Tort Claims Act (“FTCA”) to go forward so that she can attempt to recover for her husband’s tragic death.
