This case arises out of defendant Jose A. Hernandez’s appeal of his conviction for possession with intent to distribute and aiding and abetting other defendants with their intent to distribute 500 grams or more of a mixture or substance containing a detectable amount of cocaine, in violation of 21 U.S.C. §§ 841(a)(1), 841(b)(1)(B) and 846. On appeal, Hernandez raises two issues.
