David Pulford’s claim against the estate of Norman Pulford was allowed by the commissioners and an appeal taken by Elliott Pulford, a legatee under the will and a creditor of the estate. On the trial the appellant contended that the claim was settled and discharged during the life time of the testator. It appeared in evidence that cross suits between the parties were pending before a justice of the peace on the same day, which were settled without trial and discontinued.
