Appeal from a judgment of the County Court of St. Lawrence County (Nicandri, J.), rendered June 21, 2004, upon a verdict convicting defendant of the crime of arson in the third degree.

Defendant was charged, in a single-count indictment, with arson in the third degree arising out of a fire in a restaurant owned by him in the Village of Massena, St. Lawrence County. Local police officers spotted defendant and a vehicle resembling that driven by defendant in the immediate vicinity of the restaurant at the time of the fire.
