KEMP, J.

This is a motion to dismiss the bill of exceptions on the grounds (1) that all matters in the case are res judicata and were decided by the supreme court in its decision in the present case in 24 Haw. 181, and (2) that *93the defendants failed to perfect their appeal to this court in time and that this court never secured jurisdiction.
