PRICE, Presiding Judge.

The appellant, Johnny L. Thomas, and forty-nine others, was convicted in the recorder’s court of the City of Eufaula, Alabama, for the offense of remaining at the place of an unlawful assembly after having *645been warned to disperse. Each defendant was fined $100.00. Appeal was taken to the circuit court where they were tried by the court without a jury. They were found guilty and fined $25.00 each. The cases were consolidated for trial and it was stipulated that the appeals would be treated as one case.
