MEMORANDUM OPINION AND ORDER
ASPEN, District Judge:
Plaintiffs Clifford Carter and Herbert Brough, former employees of Signode Industries, Inc., filed this four-count class action against Signode Industries, its successor Signode Corporation (hereafter, collectively “Signode”), the Signode Employees’ Savings & Profit Sharing Plan (“the Plan”), the other individual trustees and fiduciaries of the Plan and the financial services firm of Stifel Nicolaus & Co.
