The proceeding here under review was instituted in January, 1903, by the rapid transit commissioners appointed under the provisions of chapter 4 of the Laws of 1891, as amended by chapter 752 of the Laws of 1894, for the “purpose of performing the duties relative to the premises which are required to be performed by such commissioners in and by the provisions of such acts of the Legis*106lature,” and which had for its object the compensating of those who had property interests in Joralemon street in the borough of Brooklyn as defined by section 39 of the said Rapid Transit Act.
