Appellant sued appellees to recover damages alleged to have been sustained by him on a certain contract for the purchase of cotton seed from appellees, which contract appellant alleged he was induced to enter into through fraudulent representations of the appellees. Appellant was engaged, at the time, in the business of buying cotton seed from growers and reselling it in and throughout Texas and elsewhere as planting seed— dealing only in seed from long staple, high grade cotton.
