DECISION AND ORDER
GRIESBACH, District Judge.
In this action, Plaintiffs seek a determination of their rights under an Employee Health Benefit Plan governed by the Employee Retirement Income Security Act of 1974, 29 U.S.C. §§ 1001, et seq. (ERISA). Federal jurisdiction exists by virtue of 28 U.S.C. §§ 1331 and 2201, and 29 U.S.C. § 1132.
Plaintiffs filed this action on March 5, 2002, against J.J. Keller & Associates (“Keller”) seeking a declaration that they were entitled to receive the entire amount due under a policy of automobile liability insurance issued by Shelby Mutual Insurance Company,…
