This is an appeal from a judgment in appellee’s favor for the sum of $1,500 assessed as damages for the alleged destruction on appellant’s part of an easement over the right of way of the Missouri Kansas & Texas Railway Company Of Texas, of which appellant was federal manager and Agent. The facts out of which the controversy arose, briefly stated, are that in December, 1886, Levin L. Clark was the owner of 150 acres of land over which the predecessors in title of the Missouri Kansas & Texas Railway Company desired to extend a line of railway.
