This action was brought by-Joel P. Smith, as we learn from the conclusions of fact found by the judge who tried the case, on February 11, 1885, against R. H. Kirby and Samuel Richards, to partition one-third of a league of land, in which the plaintiff asserted title to three-fourths, and alleged title to the residue to be in the defendant Kirby.
