Once again we appraise the shelf life of “fresh” complaint in a sexual assault case. See Commonwealth v. Montanino, 409 Mass. 500, 507-511 (1991); Commonwealth v. Dion, 30 Mass. App. Ct. 406 (1991); Commonwealth v. Gardner, 30 Mass. App. Ct. 515 (1991). There are also issues of access by the defense to records of the Department of Social Services (DSS). Kenneth E. Hyatt, the defendant, was convicted by a jury of rape of a child under the age of sixteen.
