This case presents an issue of first impression whose resolution requires consideration of both the Foreign Sovereign Immunities Act (28 USC § 1602 et seq.) (the FSIA) and New York statutory scheme concerning prejudgment attachments (CPLR 6201 et seq.). The question, put most simply, is whether the postattachment nationalization of a defendant and its property requires, as a matter of statutorily created sovereign immunity, the denial of the plaintiff’s motion for an increased attachment and/or the vacating of the prior attachment.
