This is an appeal from a judgment of conviction on two counts of an information wherein the appellant was charged with violating the provisions of section 288 of the Penal Code, and from the order denying appellant’s motion for a new trial.
In an information filed in Los Angeles County it was charged that the appellant did, on or about September 28, 1956, commit a lewd and lascivious act upon and with the body of a 7-year-old boy; and in count II thereof it was charged that appellant did, on or about September 30, 1956, commit a similar act upon and with the body of an 8-vear-old girl.
