Millcreek Township (Township) and the Angela Cres Trust of June 25, 1998 (Trust) have challenged three orders of the Court of Common Pleas of Erie County (trial court) awarding the Trust $517,868 in attorney fees and expenses and $164,000 in expert fees and expenses that were incurred by the Trust in a condemnation proceeding. The Township asserts that the Trust's request for reimbursement of its costs in successfully defending the condemnation was filed untimely, depriving the trial court of jurisdiction.
