This action for declaratory judgment concerns conflicting claims to settlement proceeds from a tort action in Tennessee. Appellant Larry Joe Martin was injured in a traffic accident and received $14,593.03 in personal injury protection (PIP) benefits from appellee Commercial Union Insurance Company (“Commercial Union”), pursuant to Georgia law and the terms of his insurance policy with Commercial Union.
