This case comes before the court on a motion to renew brought by the mother of a child born out of wedlock, pursuant to CPLR 5015. The present petitioner wishes to have the court’s dismissal of a paternity proceeding reconsidered. The prior proceeding was brought by the Commissioner of Social Services against an alleged putative father, and was terminated with prejudice, on the consent of both parties.
