The defendant, Herbert L. Miner was convicted in the Circuit Court of Jackson County of “felony murder.” He appeals.

On Sunday, January 12, 1975, sometime after 10 p.m., the Reverend Gary Tanner placed a telephone caU to the Williamson County sheriffs department. Reverend Tanner, calling on behalf of the defendant, informed one Deputy Cradle that the defendant had been involved in a shooting earlier that night.
