By an information filed in the municipal court of Chicago John Doe of Rosehill Cemetery Company was charged with the violation of section ib of the act entitled, “An act in relation to the control of public graveyards.” (Laws of 1927, p. 195; Cahill’s Stat. 1927, p. 214; Smith’s Stat. 1927, p. 232.) The section reads as follows: “It is unlawful for a trustee or person in control of any cemetery or public graveyard in the State of Illinois to make or enforce a rule or by-law prohibiting the erection of headstones, approved by the United States government or by the State of Illinois,…
