Appeal from the Court of Quarter Sessions of the Peace of Allegheny county: Of October and November Term, 1885, No. 104. This was an appeal bv the Protestant Orphan Asvlum of Pittsburgh and Allegheny, Martha Watson, R. Millei’, Jr., Joseph N. Patterson, Thomas H. Patterson, and James F. The Act of the 13th of May, 1871, Avas evidently devised for the purpose of avoiding the constitutional prohibition against unequal taxation aiid to render as far as possible ineffectual the blow struck at this kind of taxation in the case of Hammett v.
