Appellant, Russell Jackson Nickerson, a Patrolman First Class with the Chestertown police department, was convicted of assault and battery and assault with intent to murder 1 by a jury in the Circuit Court for Kent County and was sentenced to a term of ten years, the final five to be suspended subject to probation. On appeal he contests the sufficiency of the evidence to support his convictions and claims error when the court
