Appeal from Birmingham City Court. Heard before Hon. John H. Miller. Action by Pratt & McCurdy against the Birmingham Railway, Light & Power Company, for damages for failure to furnish gas. Judgment for defendant, and plaintiff appeals.

This case was before this court on a former occasion. 10 Ala. App. 273, 4 South. 510. It came here then on an application for certiorari to review the opinion and ruling of the Court of Appeals. — 187 Ala. 511, 65 South. 533. A statement of the general nature of the case, sufficient for our purposes at this time, *639may be found in the reports of the former appeal, supra. On the return of the cause to the trial court the complaint was amended to meet the rulings of this court and the Court of Appeals.
