Affirming.

The appellant, Inter-Mountain Coal & Lumber Company, owns several large tracts of land in Harlan county and is engaged in the business of cutting and manufacturing into lumber the timber thereon. The appellee, Bishop Boggs, has been engaged in the logging business for a number of years and has been employed from time to time by the appellant and its predecessors in title over a period of more than 30 years.
