This case is before us for the second time, our former decision béing reported in 240 U. S. 264. It was an action for damagés, brought by the present petitioner as plaintiff against the présent respondent as defendant in the District Court of the United States for Porto Rico. Our first review was upon a direct writ of error sued out by plainiiff under § 244, Judicial Code (Act of March 3, 1911, c. 231, 36 Stat. 1087, 1157), prior to the amendment of'January 28, 1915 (c. 22, 38 Stat. 804, §§ 3 & 6).
