OPINION

By DAY, J.

This cause came on for oral hearing and during the oral testimony the parties entered into a certain stipulation of facts and then requested an opportunity to submit briefs to the Court. The plaintiffs then filed a motion to be permitted to amend their petition after trial. This motion was granted as was a motion to amend the answer. Thereafter, the firm of Squire, Sanders & Dempsey requested permission of the Court to file a brief amicus curiae.
