Advanced Spine Centers, Inc. (“Advanced Spine”) brought this action against Commerce Insurance Company (“Commerce”) to recover personal injury protection (“PIP”) payments pursuant to G.L.c. 90, §34M for chiropractic treatment it provided to Commerce’s insured, and damages for Commerce’s alleged violations of G.L.c. 93A, §11, G.L.C. 176D, and G.L.c. 93, §12. On the day of trial, Advanced Spine withdrew its G.L.c. 90, §34M claim.
