This-is an appeal on questions of law and fact from a judgment of the Court of Common Pleas permanently enjoining the defendant from proceeding with the construction of any structure upon or from exercising private control or enjoying private possession of Hot No. 1 on the Salem Heights plat, Harrison Township. Montgomery county, Ohio. The appeal requires the consideration de novo of the case.
