Granting in Part and Denying In Part the Defendant’s Motion for Summary Judgment

I. INTRODUCTION

Early in the morning of September 7, 2003, Elizabeth Anton (represented in this action by her mother, Grace Anton), a hostess at the defendant restaurant, fell from an eighth floor residential balcony to her death. Anton was intoxicated at the time of her death and was twenty years of age.
