This is an action in tort, in which the plaintiff seeks to recover damages for injuries to his automobile, caused by a collision with a truck owned by the defendant and driven at the time by the latter’s agent. The verdict and judgment were for the plaintiff and the cause is here upon the defendant ’s exceptions.

At the close of the evidence the defendant moved for a directed verdict, upon the grounds, briefly summarized, that the plaintiff had failed to show that any negligence of the defendant’s agent was a part of the proximate cause of the accident, and that the plaintiff himself and the…
