Antonio Sandoval (the “Plaintiff’), a resident of Westchester County, filed this diversity action on September 12, 2005 alleging negligence, as well as violations of state and federal labor laws, by an entity named in the Complaint as The Abaco Club on Winding Bay 1 , a corporation organized under the laws of the Bahamas with its principal place of business in the Bahamas, and Peter De Savary (“De Savary”), the owner and operator of The Abaco Club.
