Once again, we are called on to decide whether the Commonwealth’s failure to meet procedural deadlines in sexually dangerous person proceedings, G. L. c. 123A, §§ 13 (a) and 14 (a), warrants the dismissal of the Commonwealth’s petition. See Commonwealth v. Parra, 445 Mass. 262 (2005); Commonwealth v. Gagnon, 439 Mass. 826 (2003); Commonwealth v. Kennedy, 435 Mass. 527 (2001). After the defendant’s motion to dismiss was initially denied, he refiled essentially the same motion as a motion for summary judgment.
