ORDER DISMISSING MOTION FOR DEFAULT JUDGMENT

JOHN A. WOODCOCK, JR., Chief Judge.

Simply because a plaintiff is certain of a sum does not make a damage claim a sum certain within the meaning of Federal Rule of Civil Procedure 55(b)(1). Because the plaintiff failed to establish under KPS & Assocs. v. Designs by FMC, Inc., 318 F.3d 1 (1st Cir.2003) that it is seeking a sum certain under Rule 55(b)(1), the Court dismisses without prejudice the plaintiffs motion for entry of default judgment.
