Duckworth, Presiding Justice.
(After stating the foregoing facts.) The question having been raised upon the argument before this court whether or not it has jurisdiction in a case of this kind, and it being the duty of the court to always inquire for itself whether or not it has jurisdiction, such an investigation has been made and it is now ruled that this court has jurisdiction. In Tomlin v. Rome Stove & Range Co., 183 Ga. 183 (1) (187 S.
