Appeal by the plaintiff, Franklin P. Roberge, from a judgment of the Supreme Court in favor of the defendants, entered in. the office of the clerk of the county of New York on the 19th day of February, 1903, upon the verdict of a jury? and also from an order entered in said clerk’s office on the 19th- day of February, 1903, denying the plaintiff’s motion for a new trial made upon the minutes.

Ingraham, J.:

The plaintiff asks for a judgment for $100,000 against the estate of Robert Bonner, deceased, upon an alleged agreement by which Robert Bonner agreed to assure to the plaintiff that sum upon his death. The question whether or not such a contract was made was submitted to the jury, who found a verdict for the defendant; -and this appeal is based upon errors committed' at the trial, mainly those in relation to the admission of evidence.
