This appeal arises from a decision by the United States District Court for the Middle District of Florida, holding the appellant liable for failing to comply with a provision of a collective bargaining agreement requiring the contribution of 1% of an employer’s gross payroll to the National Electrical Industry Fund (NEIF), an industry promotion fund. 1 Appellant argues that it was not bound by the NEIF provision because it neither authorized the Florida West Coast Chapter of the National Electrical Contractors’ Association (FWCC, NECA) to negotiate such a provision on…
