A motion was entered in this court to dismiss the appeal, upon the ground that an appeal did not lie from the county to the circuit court, and the case of Peak v. The People, 76 Ill. 289, is referred to in support of the motion. That motion having-been reserved to the final consideration of the case, we have considered and decided the motion as preliminary to the examination of the errors assigned on the record.
