NATURE OF CASE

Caspers Construction Company (Caspers) was the subject of a compliance review conducted by the Nebraska State Patrol’s carrier enforcement division to evaluate Caspers’ highway safety performance. As a result of the review, Caspers was charged with multiple violations of federal motor carrier safety regulations adopted in Nebraska. Caspers was ultimately assessed a civil penalty for the violations. On appeal, the district court affirmed the penalty. Caspers appeals.
