This is an action to recover for the education and maintenance of one Ruth M. Lytle, a deaf mute under the age of twelve years, who was admitted to the plaintiff institution from the county of Broome pursuant to a designation made by one of the supervisors of that county.
Defendant demurs to the complaint and urges that it does not state facts sufficient to constitute a cause of action, in that it fails to allege the making and filing of a certificate by the state board of charities that plaintiff has been duly organized and is prepared for the reception and instruction of deaf mute pupils;…
