This proceeding was commenced in the district court of Jefferson county by Cora Kelly in her individual capacity and as administratrix with will annexed of the estate of T. B. Kelly, to vacate a judgment rendered in a certain action instituted by her as ad-ministratrix aforesaid against the personal representatives of one E. J. Kelly, deceased, for an accounting and to obtain judicial construction of the will of the said T. B. Kelly. Plaintiff below appeals from a judgment rendered on sustaining demurrer to her evidence.
