This is an appeal from the district court of Oklahoma county rendered June 7, 1922, adjudging the defendant in error, R. A. Vose, to be the owner of certain lands therein described and quieting his title thereto as against plaintiff in error. Anna L. Penny.

It appears that prior to the controversy that culminated in this lawsuit, Oren S. Penny and Anna L. Penny, his wife, had contracted with one Gillespie to exchange certain farm lands in Grady county comprising about 600 acres, a part of which belonged to her and part to her minor children.
