This is a petition for a writ of mandamus to compel the respondents, the superintendent of schools and the school committee of the city of Quincy, to reinstate the petitioner to the position of a teacher in the public schools of the city. The case is before us on the re spondents’ appeal from an order for judgment in favor of the petitioner.

The principal issue presented by the petition is whether the petitioner, at the time the respondents purported to terminate her employment, had acquired tenure under G. L. c. 71, § 41, as amended through St. 1956, c. 132, § 1. If she had, she could be…
