OPINION

DAVIS, Chief Justice.

Service Finance filed suit against Adriatic Insurance Company and its surplus lines agent American Recreational Markets, Inc. (collectively, “Appellees”) to recover unearned premiums and premium receipts taxes on three cancelled insurance policies for which Service Finance had provided premium financing. Service Finance alleges breach of express or implied contract and violation of article 24.17 of the Insurance Code.
