This is a suit for damages based on the negligence of appellant in inflicting personal injuries upon the appellee, by running a locomotive attached to a train against him, while he was upon the track of appellant, within the corporate limits of the city of Fort Worth. The grounds of negligence were that no lookout was kept for persons on the track, where it had been used as a passageway by many persons, with the knowledge and acquiescence of appellant; that no whistle was sounded or bell rung to notify appellee of the approach of the train, although required by ordinance to ring bells…
