On October 18, 2004, the defendant-petitioner, Otis Antonio Smith ("Smith"), pled guilty in the United States District Court for the Western District of Virginia to one count of conspiracy to distribute 50 grams or more of cocaine base, in violation of 21 U.S.C. §§ 841(b)(1)(A) and 846.
