COFFEY, Circuit Judge.

Rodolfo Garcia, also known as Rafael Guereca, was convicted by a jury of conspiracy to distribute heroin and distribution of heroin in violation of 21 U.S.C. §§ 841(a)(1) and 846, and was sentenced to life imprisonment. Guereea’s attorney moved to withdraw as appellate counsel, see Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967), which we denied finding that the claim that the government engaged in sentencing manipulation was nonfrivolous. United States v.
