This case is the aftermath of prior litigation, a full summary of which is set forth in Alexander v. Clarkson, 96 Kan. 174, 150 Pac. 576. This prior litigation had two main aspects: one was an accounting suit between the plaintiff and some of the present defendants as his partners in the milling business, and the other was an action by the First National Bank of Winfield against those defendant partners to recover on certain promissory notes evidencing certain of the partnership indebtedness and in which action the plaintiff, Alexander, had…
