On tbe 8tb day of March, 1919, plaintiff in error, E. E. Conkright, hereafter referred to as defendant, was convicted in tbe district court of Nowata county of tbe crime of grand larceny and sentenced to serve a term of five years’ imprisonment in tbe state penitentiary.
